2. Sofern die Veranstaltung vor Beginn abgesagt wird, besteht nur ein Anspruch auf Erstattung des Nennwertes der Eintrittskarte. Die Veranstaltung kann bis zum Beginn ohne Angabe von Gründen abgesagt werden. Ein darüber hinausgehender Schadensersatzanspruch besteht nicht. Die Veranstaltungen finden bei jeder Witterung statt, solange der Veranstalter die Umstände des Wetters verantworten kann. Sollten durch die Witterungsumstände Gefahr für Körper und Gesundheit bestehen, wird die Veranstaltung sofort abgebrochen. In diesem Falle sowie bei Abbruch der Veranstaltung aus sonstigen Gründen höherer Gewalt, aufgrund behördlicher Anordnung oder gerichtlicher Entscheidung, sowie der Gefährdung von Berlin Carnival Weekenderbesuchern durch Fehlverhalten anderer oder der drohenden Eskalation, durch zu große Menschenansammlungen, besteht kein Rückvergütungs- oder Schadensersatzanspruch, es sei denn, dem Veranstalter kann Vorsatz oder grobe Fahrlässigkeit zu Last gelegt werden. 2a. Der Veranstalter behält sich das Recht vor aus Sicherheitsgründen den Zugang zu Bereichen des Weekendergeländes, wie z.B. Bühnen wegen Überfüllung zu beschränken. Hieraus ergeben sich keine Schadensersatzansprüche, da eine genaue Planbarkeit der Besucherströme unmöglich ist.

3. Dem Weekenderbesucher ist bewusst, dass Musikveranstaltung eine Umgebung mit hohem Schallpegel darstellen. Der Weekenderveranstalter trifft die notwendige Vorsorge, um dauerhafte Hör- oder Gesundheitsschäden zu unterbinden. Gleichwohl wird den Weekenderbesuchern zum Schutz vor etwaigen Hör- oder Gesundheitsschäden dringend empfohlen, Ohrstöpsel zu benutzen. Diese gibt es an jedem Veranstaltungsort sowie bei den Hilfsdiensten. Der Besuch der Veranstaltung erfolgt daher auf eigene Gefahr. Eine Haftung des Veranstalters für auftretende Hör- oder Gesundheitsschäden aufgrund mangelnder Vorsorge ist daher ausgeschlossen, es sei denn der Veranstalter handelt grob Fahrlässig oder mit Vorsatz.

4. Schadensersatzansprüche gegenüber dem Veranstalter aufgrund Fahrlässigkeit sind ausgeschlossen. Dies gilt auch für seine gesetzlichen Vertreter oder seine Erfüllungsgehilfen. Diese Regelung gilt nicht für Schäden aufgrund Verletzung des Körpers, Lebens, Gesundheit, sowie bei grober Fahrlässigkeit oder Vorsatz des Veranstalters (außer Nr. 2) oder aufgrund der Verletzung wesentlicher Vertragspflichten, wobei hierbei der Schadensersatzanspruch auf den Ersatz des vorhersehbaren, typischen Schadens beschränkt wird. Weitergehende Haftungen sind ausgeschlossen.

5. Es ist untersagt, Glasbehälter jeder Art, Kanister, Plastikflaschen, PET Flaschen, Dosen und/oder sonstige Trinkbehälter, eigene Lebensmittel, Hartverpackungen, Kühltaschen, sonstige schwere Behältnisse, Fackeln, pyrotechnische Gegenstände, Waffen aller Art sowie sonstige gefährliche Gegenstände in die   Veranstaltungsorte mitzunehmen. Beim Einlass findet eine Sicherheitskontrolle statt. Der Ordnungsdienst ist angewiesen, eine Leibesvisitation vorzunehmen. Der Besucher erklärt sich mit Kartenerwerb damit einverstanden. Bei Verstoß gegen gesetzliche Vorschriften oder diese Regelungen kann ein Verweis vom Veranstaltungsgelände erfolgen. In diesem Fall ist eine Rückvergütung und Schadensersatz ausgeschlossen, soweit dem Veranstalter nicht selbst grobe Fahrlässigkeit oder Vorsatz zur Last gelegt werden kann.

6. Fotografieren für den privaten Gebrauch ist grundsätzlich gestattet – es sind nur Kleinbildkameras, einfache Spiegelreflexkameras und Handys mit Kamerafunktion auf dem Gelände zugelassen. Nicht zugelassen sind Kameras mit Zoomobjektiven oder mit Videofunktion sowie Aufzeichnungsgeräte (MP3/ MP4-Rekorder, Diktiergeräte etc.) jeglicher Art und Weise. Generell sind Mitschnitte jeglicher Art ohne die explizite Genehmigung des Veranstalters oder eines Künstlers verboten und die Veröffentlichung solcher Aufnahmen wird strafrechtlich verfolgt.

7. Der Veranstalter behält sich das Recht vor, die Veranstaltung örtlich und/oder terminlich zu verlegen, soweit dies für den Besucher zumutbar ist und 1 Woche vor Veranstaltungsbeginn bekannt gegeben wird. Ebenso behält er sich das Recht vor, das Programm zu ändern. Absagen oder Änderungen werden durch den Veranstalter so früh wie möglich bekannt gegeben und können auch noch nach Beginn des Weekenders aus wichtigem Grund stattfinden. Änderungen während des Weekenders werden auf den Leinwänden und durch Aushänge bekannt gegeben. Hieraus können seitens des Weekenderbesuchers keine Ansprüche jedweder Art abgeleitet werden, es sei denn der Veranstalter handelt grob Fahrlässig oder mit Vorsatz.

8. Sofern der Besucher das Recht erhält, sein Fahrzeug auf oder an den Veranstaltungsorten zu parken, geschieht dies auf eigene Gefahr. Für Beschädigung oder Diebstahl übernimmt der Veranstalter keine Haftung, es sei denn ihm fällt Vorsatz oder grobe Fahrlässigkeit zur Last.

9. Der Veranstalter haftet nicht für verloren gegangene oder gestohlene Sachen.

10. Jede gewerbsmäßige Handlung seitens der Weekenderbesucher ist ohne vorherige schriftliche Zustimmung des Veranstalters untersagt.

11. Auf dem gesamten Weekendergelände wird das Hausrecht vom Veranstalter bzw. von durch beauftragte Dritte ausgeübt.

12. Das so genannte Stage diving, crowd surfing, Pogen, das Klettern auf die Bühne, Traversen oder ähnliches ist grundsätzlich untersagt. Ein solches Fehlverhalten kann zum Ausschluss von der Veranstaltung führen.

13. Jugendschutz

13.1. Auf dem Weekendergelände gelten die Bestimmungen des Gesetzes zum Schutz der Jugend in der Öffentlichkeit.

13.2. Kinder und Jugendliche unter 18 Jahren ist der Zutritt nicht gestattet.

14. Für den Veranstalter ist die Einhaltung der geltenden Datenschutzbestimmungen im Rahmen der Personalisierung des Tickets eine Selbstverständlichkeit. Der Veranstalter nutzt die Daten im Rahmen der gesetzlichen Bestimmungen, zur Durchführung des Vertrages. Der Kunde kann einer Nutzung oder Übermittlung seiner Daten Zwecken der Markt- oder Meinungsforschung beim Veranstalter jederzeit widersprechen. Wenn der Kunde dieser Verwendung seiner Angaben insgesamt widersprechen möchte, genügt eine Nachricht an:

15. Die Abgabe von Getränken erfolgt nach den Regeln der einzelnen Veranstaltungsorte. Auf die Getränke kann Pfand erhoben werden.

16. Mit dem Betreten der einzelnen Veranstaltungsorte willigt der Weekenderbesucher unwiderruflich in die unentgeltliche Verwendung seines Bildnisses und seiner Stimme für Fotografien, Live-Übertragungen, Sendungen und/ oder Aufzeichnungen von Bild und/ oder Ton, die vom Veranstalter oder dessen Beauftragten in Zusammenhang mit der Veranstaltung erstellt werden, sowie deren anschließenden Verwertung in allen gegenwärtigen und zukünftigen Medien (wie insbesondere in Form von Ton und Bildträgern sowie der digitalen Verbreitung, z.B. über das Internet, ein.

17. Der Käufer darf die Eintrittsberechtigung nicht als Preis bei einem Gewinnspiel oder Preisausschreiben oder sonst zu Werbezwecken einsetzen. Die Karten sind personalisiert. 18. Für alle Streitigkeiten auf vertraglicher oder gesetzlicher Grundlage wird – soweit gesetzlich zulässig – als Gerichtsstand Berlin vereinbart; es gilt deutsches Recht.
